The Patent Attorney reports to Global Head of Intellectual Property.  The successful candidate will collaborate with attorneys and paralegals in the Company’s legal organization, members of the engineering and product groups, and other professionals throughout the organization.  Day-to-day responsibilities will include patent portfolio development, handling new and pending patent filings, assisting and supporting Company employees with the invention disclosure process, providing IP support for transactional matters, intellectual property counseling, and handling a wide variety of other matters as needed.  This newly-created role presents a competitive learning opportunity in a fast-paced, exciting environment.

Main Duties

  • Develop and implement strategy for patent portfolio development
  • Manage outside counsel drafting and prosecuting patents
  • Work with Patent Review Board members to prioritize disclosures
  • Prepare, file, and prosecute some patent and trademark applications
  • Advise on intellectual property rights issues including copyright, trademark and patent matters
  • Provide intellectual property training for Company employees
  • Analyze and mitigate the risks of third party intellectual property
  • Counsel engineering teams on use of open source software
  • Provide intellectual property support in product release process
  • Collaborate regularly with product and engineering teams to provide timely, pragmatic, and business-focused legal advice, even in ambiguous situations
  • Report periodically on the impact of intellectual property in the Company
  • Provide intellectual property support in transactional matters, including license agreements, strategic partnerships, and mergers and acquisitions
  • Create internal policies, operational procedures, user-facing policy and internal compliance guidelines regarding intellectual property
  • Invention disclosures identified and converted to valuable patent applications on schedule and in budget.
  • Timely, strategic feedback to outside counsel.
  • Ongoing communication and collaboration with inventors, patent review board, and patent legal team.
  • Legal advice reflecting an understanding of the Company’s technology and business.
  • Effective meetings with engineering teams to harvest inventions.
  • Product reviews conducted in connection with the product release process.

Experience and Skills

Minimum Experience:

Minimum of 5 years’ experience OR the equivalent combination of education and experience. In cases of internal promotion, an exception may be made to the minimum requirements based on company needs and the proven ability of the incumbent to perform the key roles and responsibilities of this position.

Special Skills, Knowledge, and Other Requirements:

  • Undergraduate degree in Computer Science, Engineering or comparable degree
  • A JD from an accredited Law School with experience in a law firm or in-house legal department prosecuting patents and performing freedom to operate or invalidity analyses
  • Strong knowledge of U.S. and foreign patent law
  • Admitted to practice the Massachusetts bar or eligible for Massachusetts In-House Attorney Registration
  • Registered to practice before the U.S. Patent and Trademark Office
  • Ability to balance competing priorities and manage several time-sensitive projects at once and ability to be flexible and self-directed in a fast-paced environment.
