Event Booking Terms and Conditions
You are asked to read the following Terms and Conditions carefully before booking places.
In these conditions "You" means the Delegate Company stated in the Registration Form.
1. Cancellation by Sophos Plc
In the unlikely event that we need to cancel this seminar, Sophos will use its reasonable endeavours to notify You.
2. Substitution
If a Delegate notifies Sophos by email of its wish to substitute a registered Delegate, Sophos reserves the right to accept such substitute Delegate. Substitution requests must be emailed to karen.wilson@sophos.com and received no later than one week prior to the event.
3. Events beyond Sophos's Control
Except as expressly provided in these conditions, Sophos shall not be liable to the Delegate by reason of any failure or delay in performing any of Sophos's obligations under these conditions if the delay or failure was due to any cause beyond Sophos's reasonable control. Without limitation, the following shall be regarded as causes beyond the reasonable control of Sophos:
(a). Act of God, act of terrorism, explosion, flood, tempest, fire or accident;
(b). War or threat of war, sabotage, insurrection, civil disturbance or requisition;
(c). Acts, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government or other authority;
(d). Strikes, lock-outs, or other industrial action or trade disputes (whether involving the employees of Sophos or of a third party); or
(e). Power failure or breakdown in machinery.
4. Right of Refusal
Sophos reserve the right to refuse admission to any Delegate if upon arrival any authorised personnel of Sophos considers, in their reasonable opinion, that the Delegate is under the influence of drink or drugs or is behaving in a threatening, abusive or otherwise unacceptable manner.
You shall comply with any regulations of Sophos and any applicable statutory requirements.
5. Food allergies/intolerances
If you are making a booking on behalf of someone else, please draw this notice to the attention of the delegate concerned.
It is each individual delegate's responsibility to inform Sophos regarding any food allergies and/or intolerances that the delegate may have.
Sophos will use its reasonable endeavours to inform its caterers of any such food allergies and/or intolerances that you have notified to us in good time.
6. Health and Safety
Sophos is concerned for the Delegate's well-being and therefore insists that all delegates shall comply with the venue's health and safety procedures which include, without limitation, not smoking whilst on the premises and only entering areas designated for use by delegates.
7. Losses, Liabilities or Indemnities
(a). You shall indemnify Sophos from and against all costs, charges, claims, expenses, demands and liabilities suffered or incurred by Sophos as a result of any act or omission by You including (without limitation) any damage caused to the venue or any property therein; and/or in connection with any breach by you of any of these terms and conditions.
(b). Sophos does not accept any responsibility for loss or damage to the Delegates property. You are responsible for reporting any loss or damage to your property to a relevant member of staff.
c). Sophos shall not be liable for any losses, damages, expenses, costs, claims or liability suffered or incurred by you (including without limitation any consequential loss, loss of profit of indirect damages) other than personal injury or death caused by the negligence of Sophos.
(d). Sophos reserves the right to amend the programme for the event.
8. Entire Agreement
(a). This Agreement comprises the entire agreement between the parties in relation to the provision of the event save for any agreement or representation made fraudulently.
(b). No purported variations or amendments to these terms and conditions shall be of any effect unless accepted in writing by Sophos.
(c). No failure or delay by Sophos in exercising any of its rights under these terms and conditions shall be deemed to be a waiver of that right.
9. Third Party Rights
A person who is not a Party to this agreement has not right to enforce any term of them under the Contract (Rights of Third Parties) Act 1999 and the parties to this agreement do not intend that any third party rights are created by this Agreement.
10. Governing Law
This Agreement shall be governed by and construed in accordance with English law.
11. Jurisdiction
The parties agree that the English courts shall have non-exclusive jurisdiction to determine any disputes that may arise out of, under, or in connection with this.
